Allison practices in LGWM’s General Liability, Architects & Engineers, and Environmental Law Practice Groups. Allison represents architects, engineers, design builders, general contractors, and subcontractors in industrial, residential, and commercial construction disputes throughout the Southeastern United States. Allison also defends environmental tort claims on behalf of chemical corporations and other entities involved in the manufacture or distribution of hazardous materials. Allison also has experience defending private corporations against civil fraud claims and professionals against malpractice and professional liability claims.

Cases of Note

General Liability:

  • Defended a private company administering probation services for a municipal court against state tort claims for abuse of process. Plaintiffs alleged the defended abused municipal court orders of probation by threatening to imprison offenders for non-compliance. We successfully obtained summary judgment on the claims of all five named plaintiffs and prevented class certification.
  • Defended a third-party administrator for a worker’s compensation carrier against a claim for the Tort of Outrage stemming from an alleged failure to provide medical care in accordance with the future benefits provision of a worker’s compensation settlement. We successfully obtained summary judgment on the claim.
  • Defended a parent corporation, its subsidiary, and an individual officer of the corporation against claims for civil fraud. The plaintiff alleged the defendants conspired to defraud it with respect to the securities sale of a subsidiary corporation. We negotiated a favorable settlement for our client prior to trial.
  • Defended an automobile dealership against claims for vicarious liability stemming from a motor vehicle accident involving its employee. We were successful in obtaining dismissal of the claim against the employer after filing a Motion to Dismiss.
  • Defended an automobile dealership against putative class claims for breach of contract brought in state court. We succeeded on a Motion to Compel Arbitration which prevented the plaintiffs from pursuing the claims on a class-wide basis.

Architects & Engineers:

  • Defended an architectural firm against claims related to the design of a buildout for a fast food franchise and a three tenant retail building shell. We successfully argued the allegedly defective area was outside the scope of the architectural services provided by our client and were able to negotiate a reasonable settlement and dismissal of all claims against it.
  • Defended an architectural firm in a lawsuit arising out of the construction of a multi-family residential project, wherein Plaintiff claimed a minimum of nine separate categories of design issues. Following our filing of a Motion to Dismiss, Plaintiff voluntarily dismissed two of its claims.

Labor and Employment:

  • Defended a health care management company against a retaliatory discharge and worker’s compensation claim of a former employee. After securing dismissal of the worker’s compensation claim, we negotiated a favorable settlement for our client on the retaliatory discharge claim.
  • Defended a government contractor against an OSHA claim and citation. Negotiated a favorable resolution of the claim which resulted in reduction of the severity of the proposed penalties against the employer.
