On October 6, 2025, a group of plaintiffs filed suit against the EPA. Rhode Island AFL-CIO et. al. v. United States Environmental Protection Agency, No. 1:25-cv-00510 (D.R.I. filed Oct. 6, 2025). The Plaintiffs include the Rhode Island AFL-CIO, Rhode Island Center for Justice, Anh Nguyen, Solar United Neighbors, Sunpath Solar, 2KB Energy Services, Energy Independent Solutions and Black Sun Light Sustainability.
The group alleges the EPA cancelled the Solar for All Program which Congress created and funded to provide low-income households and disadvantaged communities with savings on their electricity bills and affordable energy through rooftop and community solar programs. The group alleges if the EPA’s “unlawful termination of the Solar for All Program is allowed to stand, nearly one million low-income households will lose access to affordable, resilient solar in communities in all states and territories, and hundreds of thousands of good-paying, high-quality jobs will be lost, especially in the low-income and disadvantaged communities Congress intended these funds to benefit”. Plaintiffs state the EPA’s actions violated federal law, including the Administrative Procedure Act and the United States Constitution.
The EPA has stated publicly it no longer has the authority to administer the program. The EPA has not filed a response to the lawsuit. This will be an interesting show down to follow.
