Cases of Note

    • Represented a City and its Engineer in a homeowner’s claim a sidewalk improvement project caused massive flooding and damage to historic property. We were able to establish the flooding was related to private construction elsewhere, rather than the City sidewalk project, and resolve the case for a nominal amount.

    • Represented civil engineer in regard to a claim that a community’s sewer system had been underdesigned and was causing hazardous waste to percolate to the surface of common areas. We demonstrated the flaws in Plaintiffs’ theories and negotiated a full release of all claims without any monetary payment.

    • Represented an architect involved in the redesign and upgrade of a municipal civic center against claims of defective handrail design in a slip and fall case. We engaged experts and conducted discovery to demonstrate the design was not defective and raised questions of fact regarding plaintiff’s own contributory negligence, which allowed us to negotiate a reasonable resolution.

    • Represented a municipal fire department and first responder involved in a motor vehicle accident while responding to an emergency call. We filed a motion to dismiss on the grounds of immunity, but prior to the hearing, we negotiated a settlement and full release for less than defense costs.

    • Represented commercial trucking company regarding an accident that occurred in a construction zone, where the client’s driver was clearly at fault. By attacking the case from a damages standpoint from the outset, we were able to negotiate a settlement well below the initial demand.

    • Represented underinsured motorist insurance carrier in car accident case with clear liability and a permanently disabled plaintiff that underwent multiple spinal surgeries allegedly caused by the accident. After the tortfeasor’s insurance carrier paid its limits right before trial, we tried the case and limited the judgment to less than our recommended settlement value.

    • Represented a private investigator against claims of invasion of privacy and intentional infliction of emotional distress. By demonstrating Plaintiff’s lack of evidence tying the client to the incident, we negotiated a full release of all claims without any monetary payment.

  • Represented a municipal animal shelter in regards to a claim in which a minor child was bitten by a dog on the premises. By attacking the amount of claimed damages and demonstrating the limited medical expenses, we were able to negotiate a settlement and full release well within coverage and avoid what would have likely been a significant jury verdict.
