Sim practices in LGWM’s Workers’ Compensation and General Liability Law Practice Groups. Sim’s practice focuses on workers compensation defense of employers, as well as ancillary claims of retaliatory discharge, outrage, co-employee and other tort claims that may arise out of claims for workers compensation benefits.
Sim also has years of experience defending personal injury claims representing individuals regarding automobile liability as well as national insurance carriers regarding uninsured and underinsured motorist coverage. Sim represents defendants in workers compensation, tort and insurance matters throughout the 67 counties of the State of Alabama.

- Successfully represented an electrical contractor in Mobile County, Alabama to resolve workers compensation claim with future medical benefits closed and protected right to reimbursement of indemnity and medical benefits provided where electrician that was electrocuted recovered from multiple third-party defendants.
- Successfully minimized health care employer’s contribution to settlement of employee in on-the-job motor vehicle accident with operator of 18 wheeler in Jefferson County, Alabama by arguing for application of the estoppel doctrine. Employee had initially applied for short term disability benefits with assertions of her injuries as not work-related and also failed to provide employer timely notice of her injuries pursuant to the Alabama Workers’ Compensation Act.
- Prevailed against an employee’s Motion to Set Aside a workers’ compensation settlement in Sumter County, Alabama. Successfully argued that there was no just cause to set aside the settlement and should be enforced.
- Successfully resolved death claim for pest control service in Talladega, Alabama under alternative defenses that mother and sibling were not dependents of employee that died in company vehicle and that claim was barred for employee’s violations of company policy as well as state traffic laws.
- Obtained dismissal of a workers’ compensation case on behalf of a manufacturer of automobile parts where employee had alleged a back injury with few records of pre-existing condition. Successfully argued that employee had failed to prosecute her claim to the detriment of employer’s defense.
- Successfully represented paper mill to workers compensation resolve claim for less than permanent total disability award where long-term employee claimed bilateral shoulder injuries from fall at work, but personal physicians had contrarily stated employee unable to work due to non-compensable Meniere’s disease.
- Obtained dismissal of workers compensation case in Jefferson County, Alabama for employment agency where employee fell at airport in transit for employer and alleged aggravation of pre-existing injuries. Successfully argued that employee had failed to prosecute his case and sanctions granted.
- Successfully defended a health care provider in a workers’ compensation case in Butler County, Alabama that involved a nurse’s claim of successive injuries. Resolved after obtaining testimony from employee that pain had largely returned to baseline after first alleged injury and that need for subsequent surgery was due to second alleged injury with different employer.
- Successfully represented telecom contractor in Mobile County, Alabama regarding whether a technician’s alleged back injury arose out of and in the course of the employee’s employment. Developed defense that Alabama Workers’ Compensation Act did not apply to alleged out-of-state injury and that the Court lacked subject-matter jurisdiction.
